General Terms and Conditions Loummé

Article 1 – Definitions
1.1 Seller: the natural or legal person who offers products to consumers, either remotely or in physical locations.
1.2 Buyer: the natural person who does not act in the exercise of a profession or business and who concludes a (distance) agreement with the seller.
1.3 Distance Contract: a contract concluded within a system organised by the seller for the distance sale of products and/or services, whereby exclusive use is made of one or more means of distance communication up to and including the moment of conclusion of the contract.

Article 3 – Applicability
3.1 These general terms and conditions apply to every offer made by the seller and to every distance contract concluded between the seller and the buyer.
3.2 Before concluding the distance contract, these general terms and conditions will be made available to the buyer. If this is not reasonably possible, the seller will indicate how these terms and conditions can be viewed and that they will be sent free of charge upon request.
3.3 The agreement is concluded when the buyer places an order and the seller accepts it by sending a confirmation.
3.4 All products shown on the website are subject to availability. The seller is not liable for typographical errors, product descriptions, or obvious errors on the website.

Article 4 – The Offer
4.1 The offer contains a complete and accurate description of the products and/or services.
4.2 The seller reserves the right to refuse an order if:

  • Product unavailability

  • Obvious errors in price or product description

  • Technical problems

  • Orders above a certain amount (if applicable)

  • Incorrect or incomplete buyer information

  • Payment problems or suspicions of fraud

Article 5 – Delivery
5.1 Delivery takes place within Europe, via a carrier designated by the seller.
5.2 After the agreement has been concluded, the seller will deliver the product as soon as possible, but no later than within 30 days.
5.3 The risk of loss and/or damage to the product shall pass to the buyer upon delivery to the buyer or its designated representative.

Article 6 – Obligations of the buyer during the cooling-off period
6.1 During the 14-day cooling-off period, the buyer will handle the product and its packaging with care. The product may only be unpacked and used to the extent necessary to assess its nature, characteristics, and functioning. When exercising the right of withdrawal, the product, including accessories, must be returned in its original condition and packaging.

Article 7 – Costs in case of withdrawal
7.1 The buyer can cancel the agreement within 14 days without giving any reason.
7.2 This period commences on the day after the buyer has received the product.
7.3 The buyer must inform the seller of the revocation within this period.
7.4 The costs of returning the item are borne by the buyer.
7.5 The seller will refund the purchase price within 14 days of receipt of the returned product, provided the product has been received in good condition.

Article 8 – Price
8.1 Prices include VAT.

Article 9 – Conformity and Warranty
9.1 The seller guarantees that the products comply with the agreement, the product description and the reasonable requirements of reliability and usability.
9.2 Any warranty from the manufacturer or importer does not affect the statutory rights of the buyer.
9.3 The color, size, and details of the jewelry may sometimes differ slightly from the images on the website. This is due to natural variations in materials and production processes and is not a reason for complaint.

Article 10 – Payment
10.1 Unless otherwise agreed, the buyer must pay within 14 days after the start of the cooling-off period.
10.2 The buyer is obliged to immediately report any inaccuracies in payment details.

Article 11 – Complaints procedure
11.1 Complaints regarding the performance of the agreement must be submitted within a reasonable period and fully described.
11.2 The seller will handle complaints in accordance with its complaints procedure and will respond within 14 days.

Article 12 – Disputes
12.1 All agreements are exclusively governed by Dutch law.
12.2 Disputes will be submitted to the competent court in the district where the seller is established.

Article 13 – Additional or deviating provisions
13.1 Deviating agreements may not be detrimental to the buyer and must be recorded in writing or stored by the buyer in a durable manner.
